Analysis tools and tools provided by third parties

When you visit our website, your browsing behaviour may be statistically evaluated. This is done using cookies, so-called analytics programs, and, where you have consented, via a server-side tagging setup, which routes certain requests first through a service provider we have engaged (stape.io) before forwarding them to the respective analytics and advertising services. The analysis of your browsing behaviour is carried out, where technically possible, in a data-minimising manner; however, complete anonymity cannot be guaranteed for all services used.

Revocation of your consent to the processing of data

A wide range of data processing transactions are possible only subject to your express consent. You can also revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

Right to object to the collection of data in special cases; right to object to direct advertising (Art. 21 GDPR)

In the event that data are processed on the basis of Art. 6 Sect. 1 lit. e or f GDPR, you have the right to at any time object to the processing of your personal data based on grounds arising from your unique situation. This also applies to any profiling based on these provisions. To determine the legal basis, on which any processing of data is based, please consult this Data Protection Declaration. If you log an objection, we will no longer process your affected personal data, unless we are in a position to present compelling protection worthy grounds for the processing of your data, that outweigh your interests, rights and freedoms or if the purpose of the processing is the claiming, exercising or defence of legal entitlements (objection pursuant to Art. 21 Sect. 1 GDPR).

If your personal data is being processed in order to engage in direct advertising, you have the right to at any time object to the processing of your affected personal data for the purposes of such advertising. This also applies to profiling to the extent that it is affiliated with such direct advertising. If you object, your personal data will subsequently no longer be used for direct advertising purposes (objection pursuant to Art. 21 Sect. 2 GDPR).

Right to log a complaint with the competent supervisory agency

In the event of violations of the GDPR, data subjects are entitled to log a complaint with a supervisory agency, in particular in the member state where they usually maintain their domicile, place of work or at the place where the alleged violation occurred. The right to log a complaint is in effect regardless of any other administrative or court proceedings available as legal recourses.

Right to data portability

You have the right to demand that we hand over any data we automatically process on the basis of your consent or in order to fulfil a contract be handed over to you or a third party in a commonly used, machine readable format. If you should demand the direct transfer of the data to another controller, this will be done only if it is technically feasible.

SSL and/or TLS encryption

Right to demand processing restrictions

  • In the event that you should dispute the correctness of your data archived by us, we will usually need some time to verify this claim. During the time that this investigation is ongoing, you have the right to demand that we restrict the processing of your personal data.
  • If the processing of your personal data was/is conducted in an unlawful manner, you have the option to demand the restriction of the processing of your data in lieu of demanding the eradication of this data.
  • If we do not need your personal data any longer and you need it to exercise, defend or claim legal entitlements, you have the right to demand the restriction of the processing of your personal data instead of its eradication.
  • If you have raised an objection pursuant to Art. 21 Sect. 1 GDPR, your rights and our rights will have to be weighed against each other. As long as it has not been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data – with the exception of their archiving – may be processed only subject to your consent or to claim, exercise or defend legal entitlements or to protect the rights of other natural persons or legal entities or for important public interest reasons cited by the European Union or a member state of the EU.

Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in section “Information Required by Law” to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

3. Recording of data on our website

Cookies

In some instances, our website and its pages use so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Contact form

If you submit inquiries to us via our contact form, the information provided in the contact form as well as any contact information provided therein will be stored by us in order to handle your inquiry and in the event that we have further questions. We will not share this information without your consent.

Hence, the processing of the data entered into the contact form occurs exclusively based on your consent (Art. 6 Sect. 1 lit. a GDPR). You have the right to revoke at any time any consent you have already given us. To do so, all you are required to do is sent us an informal notification via e-mail. This shall be without prejudice to the lawfulness of any data collection that occurred prior to your revocation.

The information you have entered into the contact form shall remain with us until you ask us to eradicate the data, revoke your consent to the archiving of data or if the purpose for which the information is being archived no longer exists (e.g. after we have concluded our response to your inquiry). This shall be without prejudice to any mandatory legal provisions – in particular retention periods.

4. Social media

LinkedIn Plugin

Our website uses functions of the LinkedIn network. The provider of this service is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.

Each time one of our pages that contains LinkedIn features is accessed, your browser establishes a direct connection to LinkedIn servers. LinkedIn is informed that you have visited our website from your IP address. If you click on the LinkedIn “Recommend” button and are logged into your LinkedIn account, LinkedIn will be able to link your visit to our website to your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the data transmitted or how it will be used by LinkedIn.

The use of the LinkedIn plug-in is based on Art. 6 Sect. 1 lit. f GDPR. The operator of the website has a legitimate interest in being as visible as possible on social media.

5. Analysis tools, tracking and advertising

The services described in this section are, where legally required, only activated if you have given us your consent via our consent banner. You may withdraw your consent or change your selection at any time, with effect for the future (see “Withdrawal of Your Consent to Data Processing” in Section 2).

Server-Side Tracking via the Google Tag Manager Server Container (stape.io)

We use a server-side tagging setup on our website via a Google Tag Manager server container. Certain requests and event data are thereby not processed exclusively directly in the browser, but are first routed through a server-side endpoint provided via the service stape.io.

The use of server-side tagging serves to improve the technical management of tracking and marketing tags, to manage data flows in a more targeted manner, and, depending on configuration, to filter, shorten, or pseudonymise data before it is forwarded to third-party services.

Within this setup, the following data may in particular be processed:

  • IP address or technical connection data
  • Header information
  • User agent
  • Browser and device information
  • Pages visited and URLs accessed
  • Referrer information
  • Event data (e.g. page views, clicks, form completions, conversion events)
  • Consent status or consent signals
  • Marketing parameters such as gclid, fbclid, or comparable identifiers, where available and permitted

Where technically possible and provided for in our setup, we use data-minimising configurations. This may in particular include the shortening, filtering, or pseudonymised further processing of individual data before it is forwarded to further recipients. Please note that technical connection data, in particular IP addresses, may initially be processed on a system basis when requests are received.

Provider / Hosting: Insofar as we use stape.io’s EU hosting, our server-side tagging setup is hosted at European server locations. The specific contractual documentation agreed with us, in particular regarding the contracting party, hosting location, and sub-processors used, is decisive in this respect. Depending on the specific contractual arrangement, the contracting party may be a European company within the Stape group or a non-European provider; the agreement concluded with us in the individual case is decisive.

Insofar as personal data is processed on our behalf, we have concluded a data processing agreement with the provider pursuant to Art. 28 GDPR. Insofar as a transfer of personal data to third countries cannot already be based on an adequacy decision, it is based on appropriate safeguards, in particular EU standard contractual clauses.

Legal basis: The storage of information on your device or access to information already stored is based, insofar as consent is required for this, on Sec. 25(1) TDDDG. The subsequent processing of personal data is based on your consent pursuant to Art. 6(1)(a) GDPR. You may withdraw or adjust consent given at any time, with effect for the future, via our consent settings.

Google Tag Manager

We use Google Tag Manager, a service for the technical management and delivery of website tags.

Google Tag Manager is used to embed and manage other services and scripts. According to Google, Google Tag Manager itself does not generally store any analytics-relevant cookies of its own. However, technical connection data may be processed when the service is accessed. Google Tag Manager itself does not regularly carry out any independent content analysis or profiling. However, other services embedded via it may process personal data, insofar as these are activated following your consent.

Legal basis: The use of Google Tag Manager is based on our legitimate interests in the efficient technical embedding and management of services on our website pursuant to Art. 6(1)(f) GDPR, insofar as the service is used exclusively for technically necessary purposes and no consent is required for this. Insofar as services requiring consent are loaded or controlled via Google Tag Manager, their use is based exclusively on your consent pursuant to Art. 6(1)(a) GDPR in conjunction with Sec. 25(1) TDDDG.

Google Analytics 4

Provided you have consented, we use Google Analytics 4, a web analytics service for the statistical evaluation of the use of our website.

Google Analytics 4 helps us understand how visitors use our website, which content is particularly relevant, and where we can technically and substantively improve our offering. It is embedded via our server-side tagging setup (see above). Depending on our specific configuration, data may initially be processed via our server-side endpoint and then forwarded to Google.

Data processed: pages visited and screen/page events; interactions on the website; technical information on browser, operating system, device, and screen; referrer URL; approximate location information (e.g. on a country or regional basis); IP address or technical connection data; identifiers and event parameters; information on consent status.

We use Google Analytics 4 in as data-minimising a manner as possible. Nevertheless, this is not a fully anonymous form of processing; personal or personally identifiable data may be processed. Insofar as IP addresses are shortened, filtered, or otherwise processed in a data-minimising manner in our setup, this is done within the scope of our technical configuration. Complete anonymity cannot be guaranteed as a general matter as a result.

Consent Mode: Where technically activated in our setup, we use Google Consent Mode to transmit consent signals to Google services in a data-protection-compliant manner and to adjust the delivery of measurement and marketing functions to your selection in the consent banner.

Legal basis: The storage of information on your device or access to such information is based, insofar as consent is required, on Sec. 25(1) TDDDG. The further processing of personal data is based on your consent pursuant to Art. 6(1)(a) GDPR.

Recipient / third-country transfer: The initial recipient of the data is Google Ireland Limited. A transfer to Google LLC, USA, cannot be ruled out. Insofar as personal data is transferred to the USA, this is based on the EU-US Data Privacy Framework, provided the respective recipient is certified accordingly. Insofar as additionally required, EU standard contractual clauses may also be used. Google Ads, Conversion Tracking, and Enhanced Conversions

Provided you have consented, we use Google Ads functions, in particular conversion tracking and, where activated, Enhanced Conversions, to measure the success of our advertising activities and to improve the attribution of conversions.

Processing may take place via our server-side tagging setup.

Legal basis: The storage of information on your device or access to it is based, insofar as required, on Sec. 25(1) TDDDG. The further processing of personal data is based on your consent pursuant to Art. 6(1)(a) GDPR.

Meta Pixel and Meta Conversions API

Provided you have consented, we use the Meta Pixel and the Meta Conversions API to evaluate the use of our website, measure the effectiveness of our advertising activities on Facebook and Instagram, and deliver interest-based advertising.

Legal basis: The storage of information on your device or access to it is based, insofar as required, on Sec. 25(1) TDDDG. The further processing of personal data is based on your consent pursuant to Art. 6(1)(a) GDPR.

Joint controllership: Insofar as we use the Meta Pixel and Meta further processes data for its own purposes, joint controllership pursuant to Art. 26 GDPR may exist in this respect. The contractual arrangements on joint controllership provided by Meta are decisive.

Recipient / third-country transfer: The recipient is Meta Platforms Ireland Limited. A transfer to Meta Platforms, Inc., USA, cannot be ruled out. Insofar as personal data is transferred to the USA, this is based on the EU-US Data Privacy Framework, provided the respective recipient is certified accordingly. Insofar as additionally required, EU standard contractual clauses may also be used.

Risk notice: We point out that the use of pixel and Conversions API technologies may be associated with data protection risks, in particular with regard to reach measurement, profiling, linking to platform accounts, and any third-country transfers.

Matomo (formerly Piwik)

This website uses the open-source web analytics service Matomo. Matomo uses so-called “cookies,” which are text files stored on your computer that enable an analysis of your use of the website. Matomo cookies remain on your device until you delete them.

7. Own services

Applications

We offer you the opportunity to apply to us (e.g. by email, post or via an online application form). The following information is provided to you regarding the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data is carried out in accordance with the applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is Section 26 of the new German Federal Data Protection Act (BDSG-neu) under German law (initiation of an employment relationship), Article 6 (1) (b) GDPR (general contract initiation) and – if you have given your consent – Article 6 (1) (a) GDPR. Consent can be withdrawn at any time. Your personal data will only be shared within our company with individuals involved in processing your application.

If your application is successful, the data you have submitted will be stored in our data processing systems on the basis of Section 26 of the new German Federal Data Protection Act (BDSG-neu) and Art. 6 (1) (b) GDPR for the purpose of implementing the employment relationship.

Data retention period

If we are unable to offer you a job, if you reject a job offer, withdraw your application, revoke your consent to data processing or request us to delete the data, the data you have submitted, including any remaining physical application documents for a maximum of 6 months after completion of the application process (retention period) in order to be able to trace the details of the application process in the event of discrepancies (Art. 6 para. 1 lit. f GDPR).

YOU MAY OBJECT TO THIS STORAGE IF YOU HAVE LEGITIMATE INTERESTS THAT OVERRIDE OUR INTERESTS.

Once the retention period has expired, the data will be deleted unless there is a legal obligation to retain it or another legal reason for further storage. If it is evident that the storage of your data will be required after the retention period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when it has become irrelevant. Other statutory retention requirements remain unaffected.

Note: If you visit the “Microsoft Teams” website, the “Microsoft Teams” provider is responsible for data processing. However, to use “Microsoft Teams” it is only necessary to visit the website to download the software for using “Microsoft Teams”.

When signing up for and joining Teams Webinars, we process your personal data.

The following personal data is or may be subject to processing:

  • User details: first name, last name, email address, country/region
  • Organization data (e.g. company’s name)
  • Meeting metadata: e.g. date, start and end time, meeting ID, phone number, location
  • Content data (e.g. text in chats, reactions / emojis, polls or survey)

8.2 Purpose of the data processing

We process your data for the following purposes:

  • To manage and facilitate your participation in the webinar (Art. 6(1)(b) GDPR)
  • To provide you with relevant information about our products and services after the webinar (Art. 6(1)(f) GDPR).
  • To share attendee data with presenters speaking in the webinar to enhance the event experience (Art. 6(1)(f) GDPR)

We may record the Teams Webinars including aforementioned data – e.g. chat texts, reactions, emojis; however not your image or voice, unless you are a “presenter”  – and publish these recordings on the legal basis of Art. 6 para. 1 lit. f GDPR.

8.3 Transfer and storage of personal data

Personal data that is processed in connection with participation in “webinars” is generally not passed on to third parties, unless it is specifically intended to be passed on. Please note that content from “webinars” often serves the purpose of communicating information with customers, interested parties or third parties and is therefore intended for disclosure.
Other recipients: The provider of “Microsoft Teams” necessarily obtains knowledge of the above-mentioned data to the extent that this is provided for in our contract processing agreement with “Microsoft Teams”.

We will retain your personal data for as long as necessary to fulfill the purposes stated in this policy. Registration data will be stored for 180 days after the webinar unless you withdraw your consent or object to further processing.

8.4 Duration of data storage

When your data is no longer necessary for the purpose for which it was originally collected and there are no statutory retention periods or other statutory grounds for further retention, your data will be routinely erased. Other reasons for further retention may include reasons of public interest or the assertion, exercise, or defense of legal claims.
